Abstract

The paper analyses the impact of the implementation of International Criminal Court's policy paper on sexual and gender-based crimes, created by the Office of the Prosecutor in 2014. The paper begins with an analysis of the international legislation regarding sexual and gender-based crimes, specifically the Geneva Conventions and Additional Protocols. Then, it further explores the definition of sexual and gender-based crimes in the Rome Statute in order to verify the differences and advances driven from the establishment of the policy paper on gender. The paper structure is composed by a theoretical research of international laws combined with academic analyses of gender issues in humanitarian crisis and an empirical research of cases at the ICC regarding sexual and gender-based crimes.
